ՏՄՊՊՀ որոշմամբ «Վիքիպեդիա» ընկերությունը ենթարկվեց պատասխանատվության

ՀՀ Տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովին դիմում-բողոք է ներկայացրել  «Վիքիմեդիա Հայաստան» գիտակրթական հասարակական կազմակերպությունը, որը հանդիսանում է միջազգային հայտնի «Վիքիմեդիա Հիմնադրամ» կորպորացիայի գործընկերը Հայաստանում: «Արմենպրես»-ի հաղորդմամբ` կազմակերպությունը հայտնել է, որ իրենց հայտնի նախագծերից է «Wikipedia» ազատ հանրագիտարանը, որը  նպատակ է հետապնդում «Wikipedia» տիրույթում հայկական վիրտուալ բովանդակության մեծացմանը և տարածմանը` նպաստելով հանրության կրթական մակարդակի բարձրացմանը: Կազմակերպությունը հայտնել է, որ Հիմնադրամի նախագծերում տեղադրված տեղեկատվությունը հասարակությանը տրամադրվում է անվճար և հասանելի է բոլորին:

Սակայն, ըստ դիմում-բողոքի, Հայաստանում գրանցվել և գործում է մեկ այլ ընկերություն՝ «Վիքիպեդիա»  անվանմամբ, որը տարբեր կազմակերպությունների դիմելով՝ առաջարկում է պատվիրել վճարովի հոդվածներ և այն տեղադրել www.wikimediaarmenia.am կայքում:

ՏՄՊՊՀ վարույթի ընթացքում պարզվել է, որ ընկերությունը վճարովի ծառայություններ է մատուցել մի շարք մարզպետարանների, քաղաքապետարանների, բուժհաստատությունների, տասնյակ իրավաբանական անձանց: Պարզվել է նաև, որ ընկերությունն առանց թույլտվության օգտագործում է Հիմնադրամին պատկանող ապրանքային նշանը և իրականացնում է գործունեություն, որը դեմ է Հիմնադրամի առաքելությանը, նպատակներին և սկզբունքներին: Նման վարքագիծը, անվանման շփոթություն առաջացնելուց բացի,  վնասում է Հիմնադրամի վարկարժեքին, քանի որ «Վիքիպեդիա»  անվանումը մշտապես ասոցացվել է լայն հանրությանը հասանելի անվճար տեղեկատվություն տրամադրող ինտերնետային հարթակի հետ:

ՏՄՊՊՀ որոշմամբ, «Վիքիպեդիա» ընկերությունը դրսևորել է անբարեխիղճ մրցակցության վարքագիծ՝ ստեղծելով և օգտագործելով այլ տնտեսվարողին պատկանող ապրանքային նշանը՝ վնասելով նրա վարկարժեքին: Օրենքի խախտման համար, ընկերությունը ստացավ նախազգուշացում՝ խախտումը վերացնելու հանձնարարականով:
