Սեֆիլյանի և մյուսների գործով նախագահող դատավորը սանկցիա կիրառեց մի քանի պաշտպանների նկատմամբ

Երևանի Շենգավիթ վարչական շրջանի ընդհանուր իրավասության առաջին ատյանի դատարանում հունիսի 27-ին լարված մթնոլորտում ընթացող Ժիրայր Սեֆիլյանի և մյուսների գործով դատական նիստը ընդմիջումից հետո շարունակվեց: «Արմենպրես»-ի հաղորդմամբ` դատավոր Տաթևիկ Գրիգորյանը ընթերցեց դատական սանկցիայի կիրառման մասին որոշում:
«Դատարանը որոշեց փաստաբան Տիգրան Եգորյանի հանդեպ կիրառել սանկցիա պատասխանատվության ենթարկելու վերաբերյալ դիմումով դիմելով Փաստաբանական պալատ: Սույն որոշումը հրապարակման պահից ուժի մեջ է և ենթակա չէ բողոքարկման»,- ասաց դատավոր Գրիգորյանը:
Նախագահող դատավորի խոսքով` արձանագրություններ են ստացվել դատական կարգադրիչների կողմից, որտեղ նշում է, որ պաշտպաններ Տիգրան Հայրապետյանը, Արայիկ Պապիկյանը հրաժարվել են ենթարկվել զննության:
«Դատարանը արձանագրում է, որ պաշտպաններ Տիգրան Հայրապետյանը, Արայիկ Պապիկյանն այս պահին ներկա չեն: Դատարանը հեռանում է պաշտպանների վարքագծի վերաբերյալ համապատասխան որոշում կայացնելու»,- եզրափակեց Գրիգորյանը:
Տաթևիկ Գրիգորյանը խորհրդակցական սենյակից վերադառնալուց հետո ընթերցեց դատարանի որոշումը` Տիգրան Հայրապետյանի, Արայիկ Պապիկյանի նկատմամբ սանկցիա կիրառելու վերաբերյալ ` պատասխանատվության ենթարկելու վերաբերյալ դիմումով դիմելով փաստաբանական պալատ:
Դատավոր Գրիգորյանը հայտնեց նաև, որ սույն գործով դատական նիստերը կայանալու են յուրաքանչյուր երեքշաբթի և ուրբաթ օրերին՝ ժամը 11:00-ին: Հաջորդ դատական նիստը կայանալու է հունիսի 30-ին ժամը 11:00-ին:
Մի շարք պաշտպաններ տվյալ ժամանակացույցի փոփոխության առնչությամբ միջնորդությամբ հանդես եկան` այլ գործերով նիստեր ունենալու պատճառով, սակայն նախագող դատավորը նշեց, որ ողջամիտ ժամկետներում դատաքննությունը ավարտելու համար այլ տարբերակ չի գտնում:
Դատարանի կարգադրիչների կողմից արձանագրություն է տրվել դատարանին` դատական նիստին մասնակցող քաղաքացիներ Վահե Պողոսյանի և Վահագն Ղումաշյանի կողմից անհարգալից վերաբերմունքի, հայհոյանք հնչեցնելու և կարգադրիչների ծառայությանը խոչընդոտելու վերաբերյալ:
«Դատարանը հիմք ընդունելով ներկայացված զեկուցագիրը և նկատի ունենալով, որ դատական նիստերի դահլիճում գտնվող քաղաքացիներ Վահե Պողոսյանը և Վահագն Ղումաշյանը խախտել են դատական նիստերի կարգը, անհարգալից վերաբերմունք են դրսևորել դատարանի նկատմամբ, դատարանը որոշում է կայացնում Վահե Պողոսյանին և Վահագն Ղումշյանին հեռացնել դատական նիստերի դահլիճից մինչև սույն քրեական գործի դատաքննության ավարտը»,-նշեց Գրիգորյանը:
Պաշտպան Արայիկ Պապիկյանն ուշացումով միացավ դատական նիստին և խնդրեց դատարանից պարզաբանում ներկայացնել իր պաշտպանյալ Ներսես Պողոսյանի բացակայության պատճառների առնչությամբ և հայտնեց, որ հեռանալու է դատական նիստերի դահլիճից, եթե չապահովվի Ներսես Պողոսյանի ներկայությունը:
«Ներսես Պողոսյանից ունեմ հանձնարարություն իր բացակայության պարագայում ներկա չգտնվելու դատական նիստերի դահլիճում: Իմ պաշտպանյալը ներկա չի գտնվում դատական նիստերի դահլիճում, ուստի նրա պաշտպանությունն իրականացնելն անհնար եմ համարում, և ես ստիպված եմ լքել դատարանը», ասաց Պապիկյանը:
Դատարանը հեռացավ խորհրդակցական սենյակ պաշտպան Արայիկ Պապիկյանի վարքագծի վերաբերյալ որոշում կայացնելու: Դատարանն ընդմիջում հայտարարեց:
