Պետական հատուկ ծառայություն իրականացնող աշխատակցի կողմից պաշտոնեական դիրքը չարաշահելու դեպքի վերաբերյալ Հատուկ քննչական ծառայությունում քննված քրեական գործի նախաքննությամբ հիմնավորվել է, որ ՀՀ ոստիկանության Շենգավիթի բաժնի ՔՀԲ օպերլիազոր Վահագն Օսեյանը, իր ընկեր Սարգիս Սողոմոնյանի դրդչությամբ, չարաշահել է պաշտոնեական դիրքն ու դիտավորությամբ չի կատարել իր ծառայողական պարտականությունները:

Այսպես, ՀՀ քաղաքացի Արմեն Կարապետյանի անվամբ ուղարկված ծանրոցի միջից առանձնապես խոշոր չափերի թմրամիջոց հայտնաբերելու դեպքի կապակցությամբ հարուցված քրեական գործի շրջանակներում` ՀՀ ԿԱ ՊԵԿ քննչական վարչության քննիչը խուզարկություն կատարելու դատարանի որոշումը ուղարկել է ոստիկանության Շենգավիթի բաժնի օպերլիազորներին` որոշման մեջ նշված հասցեում խուզարկություն կատարելու համար: 27.10.2016թ.-ին Շենգավիթի բաժնի ՔՀԲ օպերլիազոր Վահագն Օսեյանը նույն բաժնի մեկ այլ օպերլիազորի հետ այցելել է նշված հասցե` իր հետ տանելով նաև ընկերոջը` Սարգիս Սողոմոնյանին, ով տեղեկացված չի եղել բնակարան այցելության նպատակի մասին: Սակայն ոստիկաններին չի հաջողվել խուզարկել Ա. Կարապետյանի տունը` վերջինիս բացակայության պատճառով: Նույն օրը պատահաբար պարզելով, որ բնակարանի տանտերն իր ընկերն է, Ս. Սողոմոնյանն այդ մասին տեղեկացրել է Վ. Օսեյանին` խնդրելով իրեն հայտնել Ա. Կարապետյանի բնակարան այցելության նպատակը: Օպերլիազորը, ընկերոջ հետ հարաբերությունները չվատթարացնելու անձնական շահագրգռվածությունից ելնելով և պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելով, առանց նման իրավասություն ունենալու, Ս. Սողոմոնյանին հայտնել է, որ բնակարան այցելել են խուզարկության նպատակով: Միաժամանակ, Վ. Օսեյանը ընկերոջ միջոցով բնակարանի սեփականատեր Ա. Կարապետյանին փոխանցել է, որ անհանգստանալու կարիք չկա` նախապես տեղեկացնելով, որ նույն օրը` երեկոյան ժամը 17:00-ին կխուզարկեն նրա բնակարանը, ընդ որում, խուզարկությունը ձևական բնույթ կկրի: Նշված ժամին օպերլիազորը Ս. Սողոմոնյանի հետ այցելել է Ա. Կարապետյանի բնակարան, սակայն այն բարեխղճորեն չի խուզարկել, այլ, շարունակելով չարաշահել պաշտոնեական լիազորությունները, ստեղծել է խուզարկություն կատարելու պատրանք, որի հետևանքով  չի կատարվել քրեական գործի հանգամանքների բազմակողմանի, լրիվ և օբյեկտիվ հետազոտման օրենսդրական պահանջը և էական վնաս է պատճառվել պետության օրինական շահերին` հեղինակազրկվել է պետական իշխանության մարմինը` ՀՀ ոստիկանությունը:

Այսպիսով, Վ. Օսեյանին պաշտոնեական դիրքը չարաշահելու համար մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով, իսկ Ս. Սողոմոնյանին` պաշտոնեական դիրքը չարաշահելուն դրդելու համար ՀՀ քրեական օրենսգրքի 38-308-րդ հոդվածի 1-ին մասով: Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու և դատարան ուղարկելու համար:
