Կայացավ Արարատ Խանդոյանի գործով հերթական դատական նիստը. պաշպանը հանդես եկավ ճառով

Երևանի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանում դատավոր Մնացական Մարտիրոսյանի նախագահությամբ հունիսի 14-ին տեղի ունեցավ Արարատ Խանդոյանի գործով հերթական դատական նիստը։

Խանդոյանի պաշտպան Արա Ղարագյոզյանը հանդես եկավ պաշտպանական ճառով: «Եթե Արարատ Խանդոյանը կատարած լիներ իրեն վերագրվող բոլոր գործողությունները, ապա նույնիսկ այդ դեպքում նրա արարքը չէր կարող որակվել քրեական օրենսգրքի 225 հոդվածի 2 մասի  հատկանիշներով: Զանգվածային անկարգությունների բացակայության պայմաններում Արարատ Խանդոյանը պարզապես չէր կարող մասնակցել դրանց: Եթե նույնիսկ վարույթ իրականացնող մարմինը գտնի, որ զանգվածային անկարգությունները,  այնուամենայնիվ, տեղի են ունեցել, ապա պետք է ապացուցել, թե հստակ, որ դեպքում Արարատ Խանդոյանը ինչ գործողություններ է կատարել: Ըստ մեղադրականի` Արարատ Խանդոյանը բռնություն է գործադրել ոստիկանության ներկայացուցչի նկատմամբ, սակայն վերը նշված վարույթ իրականացնող մարմինը քրեական գործով չի ապացուցել, որ իմ պաշտպանյալը որևէ մեկին հարվածել է ոտքով կամ ձեռքով կամ փորձել է խլել վահանը: Նման պարագայում պետք է լինեն տուժողներ, սակայն այս դեպքում չկա տուժող, ով ցուցմունք կտա, որ Արարատ Խանդոյանը իրեն բռնության է ենթարկել»,- նշեց պաշտպանը:

Արա Ղարագյոզյանը չի գտնում, որ իր պաշտպանը կատարել է հանցագործություն: «Միջնորդում եմ Արարատ Խանդոյանի նկատմամբ առաջադրված մեղադրանքում ճանաչել անմեղ և նրա նկատմամբ իրականացնել արդարացման դատավճիռ, ինչպես նաև դատական նիստերի դահլիճից ազատ արձակել»,- ասաց պաշտպանը:

Արարատ Խանդոյանը դատավորից խնդրեց 10 օր ժամանակ տրամադրել ճառը պատրաստելու համար:

Դատավոր Մարտիրոսյանը ընդունեց ամբաստանյալի խնդրանքը և նշանակեց հաջորդ դատական նիստը հունիսի 27-ին՝ ժամը 11:00-ին:

Նախորդ նիստում դատախազ Հայկ Պետրոսյանը 4 տարվա ազատազրկում է պահանջել նշելով, որ կան բավարար ապացույցներ, որ նա մասնակցել է զանգվածային անկարգությունների, ինչպես նաև բռնություն է գործադրել ոստիկանների նկատմամբ։ Խանդոյանը մեղքը չի ընդունում և նշում է, որ հենց ինքն է բռնության ենթարկվել: Արարատ Խանդոյանը մեղադրվում է 2016 թվականի հուլիսի 20-ին Երևան քաղաքում տեղի ունեցած հասարակական անկարգությունների ժամանակ ոստիկանության ներկայացուցչի նկատմամբ բռնություն կիրառելու համար:
