Կառավարությունը օրենքի ուժով փակում է մարդկանց հետդարձի ճանապարհը. «Ժամանակ»

«Ժամանակ» թերթը գրում է.

«Կարեն Կարապետյանի գլխավորած կառավարությունը մայիսի 18-ի նիստում առանց  առանձնակի  ուշադրության արժանացնելու  հավանություն տվեց  «ՀՀ հողային օրենսգրքում լրացումներ եւ հարակից մի շարք օրենքներում փոփոխություններ եւ լրացումներ կատարելու մասին» օրենքների նախագծերի փաթեթին, որը հետագայում բազում անցանկալի հետեւանքների տեղիք է տալու:

Կառավարության հաստատած փոփոխությունները վերաբերում են սեփականության իրավունքով գյուղատնտեսական նշանակության հողեր ունեցող ՀՀ այն քաղաքացիներին, ովքեր կորցրել են կամ առաջիկայում կկորցնեն ՀՀ քաղաքացիությունը: Համաձայն նախագծերի՝ այդ քաղաքացիները պարտավոր են 1 տարվա ընթացքում օտարել իրենց սեփականաշնորհած գյուղատնտեսական նշանակության հողերը, այլապես դատարանը վճիռ է կայացնում, եւ կատարվում է հողի հարկադիր վաճառք, ստացված գումարն էլ հանձնում է նախկին սեփականատիրոջը:

Մեծ առումով  օրենսդրական այս փոփոխությունը  վերաբերում է մեր այն հայրենակիցներին, որոնք ժամանակին սեփականության իրավունքով հող ստանալով՝ տարիներ հետո հեռացել են հայրենիքից: Սրանց մի մասը արդեն իսկ օտարել է իրենց հողը, մի զգալի մասն էլ իրենց ու իրենց զավակների ապագան տեսնելով միայն հայրենիքում՝  չեն օտարել ունեցած անշարժ գույքը:

Նշենք, որ Հայաստանում էլ քիչ չեն  մարդիկ, որոնք ունեն ՌԴ քաղաքացիություն՝ դարձյալ բարձր կենսաթոշակ ստանալու նպատակով: Կառավարության հաստատած օրենքի նախագծով այդ մարդիկ իրենց իսկ հայրենիքում զրկվելու են  կամ 25-30 տարվա սեփականությունից, կամ էլ օր ծերության մի քանի դրամ ավելի կենսաթոշակ ստանալու հնարավորությունից:

Սա ընդունված նախագծի մեկ, բայց շատ կարեւոր կողմն է: Մյուս՝ ավելի վտանգավոր պահն այն է, որ հազարավոր դրսի մեր հայրենակիցներն արդեն վաճառել են իրենց հողերը, բայց առայժմ առանց վավերացման: Կադաստրի եւ նոտարական գրասենյակների օրենքով եւ օրենքից դուրս սահմանած ահռելի գներից խուսափելով (երբ ցանկացած առքուվաճառքի գործարքի ձեւակերպումը գերազանցում է 200-300 դոլարը)՝ նրանք գործարքն իրականացնում են ավելի «մատչելի  մեխանիզմով». հողատիրոջը վճարվում է հողի գինը, իսկ  գնորդը 10 տարի շարունակ իր անունով  հողի հարկերը վճարելուց հետո դատարանով սեփականատիրոջ անվանափոխություն է կատարում:

Եվ, որ ամենակարեւորն է, դրսում գտնվողներից շատերը դեռ վերջնականապես չեն կողմնորոշվել՝ վերադառնա՞լ հայրենիք, թե՞ ոչ: Կառավարությունն այս նախագծով շատերի առաջ փակում է վերադարձի ճանապարհը: Այդքանով հանդերձ՝ անհասկանալի է կառավարության նման մոտեցման իմաստը. եթե օրենքը նոր Սահմանադրությանը համապատասխանեցնելն է,  ապա դրա համար կա հարցի լուծման պարզագույն  տարբերակ՝ օրենքը չտարածել նախկինների վրա: Եթե այլ է, ապա դա մի ուղղվածություն ունի՝ մարդկանց հեռացնել հայրենիքից: Այլապես մի կողմից՝ հայտարարվում է  ապագայի 4 մլն-անոց Հայաստանի մասին, ու մյուս կողմից՝ օրենքի ուժով  փակվում է  հայրենիքից հեռացածների  հետդարձի ճանապարհը»:
