ՄԻԵԴ-ը Հայաստանին պարտավորեցրել է 3600 եվրո վճարել «Նիկողոսյանն ընդդեմ Հայաստանի» գործով

Մարդու իրավունքների եվրոպական դատարանն այսօր հրապարակել է «Նիկողոսյանն ընդդեմ Հայաստանի» գործով վճիռը:


Հայաստանի Հանրապետության դեմ բողոքը ներկայացրել է Ռոբերտ Նիկողոսյանը՝ Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին կոնվենցիայի 34-րդ հոդվածի հիման վրա՝ 2011 թվականի դեկտեմբերի 3-ին:


Նշվում է, որ հայցվորը եղել է Պետեկամուտների կոմիտեի նախկին աշխատակից: 2009 թվականին նա ազատվել է աշխատանքից: Երևանի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանը նրա օգտին վճիռ է կայացրել և աշխատանքից ազատման որոշումն անվավեր ճանաչել, ինչպես նաև հրահանգել վերականգնել նրան նախկին պաշտոնում և փոխհատուցում տրամադրել:


Հայցվորը ՄԻԵԴ-ում մասնավորապես բողոքել է, որ համապատասխան քայլեր չեն ձեռնարկվել դատարանի վերջնական վճիռը կյանքի կոչելու համար, քանի որ նա չի վերականգնվել իր նախկին պաշտոնին, իսկ իր հարկադիր բացակայության համար սահմանված փոխհատուցման մի մասը մնում է չվճարված: Նա մասնավորապես պահանջում էր 10 մլն 506 հազ 871 դրամի համապատասխան փոխհատուցում:


Եվրոպական դատարանը վճռում նշել է, որ 2009 թվականի օգոստոսի 11-ի դատավճիռը, որը բարենպաստ էր հայցվորի համար, հինգ տարի չի կիրառվել, իսկ իշխանությունները չեն պատճառաբանել այդ հետաձգումը: Դատարանը, հետևաբար, գտել է, որ Հայաստանի իշխանությունները, չկարողանալով ձեռնարկել անհրաժեշտ միջոցները վճիռն իրագործելու համար,  խախտել են կոնվենցիայի հոդվածները:


Դատարանը մերժել է հայցվորի պահանջը նյութական վնասի փոխհատուցման վերաբերյալ՝ նշելով, որ նյութական վնասի փոխհատուցման անհրաժեշտություն չկա, քանի որ այն արդեն մասամբ վճարվել է հայցվորին:


Դատարանը վճռել է, որ խախտվել է արդար դատաքննությանն առնչվող Մարդու իրավունքների եվրոպական կոնվենցիայի 6-րդ հոդվածի 1-ին կետը և սեփական գույքից անարգել օգտվելու իրավունքին առնչվող 1-ին արձանագրության 1-ին հոդվածը:


Մարդու իրավունքների եվրոպական դատարանը Հայաստանին պարտավորեցրել է վճարել 3.600 եվրո՝ որպես ոչ նյութական վնասի փոխհատուցում:
