ՀՀ հատուկ քննչական ծառայությունում պաշտոնեական դիրքի չարաշահման և խարդախության դեպքերի վերաբերյալ քննվող քրեական գործի շրջանակներում կալանավորվել է ՀՀ ոստիկանության Շիրակի մարզային վարչության Գյումրի քաղաքի Մուշի բաժնի համայնքային ոստիկանության բաժանմունքի նախկին պետը, ով, չարաշահելով պաշտոնեական դիրքը, Գյ ումրի քաղաքի բնակիչ Ա. Ղ.-ից խաբեության և վստահությունը չարաշահելու եղանակով զգալի չափերով գումար է հափշտակել:

Ինչպես տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից, հիշյալ քրեական գործի քննությամբ պարզվել է, որ նոր անձնագիր ստանալու համար Գյումրի քաղաքի բնակիչ Ա. Ղ.-ին անհրաժեշտ է եղել վերականգնել կորցրած զինվորական գրքույկը, որի համար դիմել է ՀՀ ՊՆ Գյումրու զինվորական կոմիսարիատի աշխատակցին, ով տարբեր պատճառաբանություններով ձգձգել է փաստաթղթի տրամադրումը և, իբր, գործընթացն արագացնելու համար Ա. Ղ.-ից կաշառք է պահանջել:

Ընդ որում, ՊՆ աշխատակցի կողմից կաշառք ստանալու պահանջը ներկայացվել է ոստիկանության Շիրակի մարզային վարչության Գյումրի քաղաքի Մուշի բաժնի համայնքային ոստիկանության բաժանմունքի պետ Հ. Վ.-ի ներկայությամբ, ով, ի պաշտոնե պարտավոր լինելով կանխել հանցանքն ու բացահայտել հանցագործության դեպքը, ոչինչ չի ձեռնարկել այդ ուղղությամբ. մասնավորապես, չի կանխել Ա. Ղ.-ի կողմից կաշառք տալը և թաքցրել է իր ներկայությամբ կատարված հանցագործությունը` այդ մասին չտեղեկացնելով իր վերադասին կամ պետական այլ իրավասու մարմնի: Ավելին, չարաշահելով Ա. Ղ.-ի վստահությունը և օգտագործելով իր պաշտոնեական դիրքը, արագ անձնագրավորելու պատրվակով նրանից պարբերաբար տարբեր չափերի գումարներ է պահանջել և ստացած 121.000 ՀՀ դրամը խաբեությամբ հափշտակել: Սակայն խոստումը կատարելու ուղղությամբ ոստիկանության հիշյալ պաշտոնյան ոչ մի գործողություն և վճարում չի կատարել` հափշտակած գումարը ծախսելով իր անձնական կարիքների համար:

Հաշվի առնելով վերոգրյալը` Հ. Վ.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 2-րդ մասի 1.1-րդ կետով և 308-րդ հոդվածի 1-ին մասով: Նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
