Ոստիկանությունը պարզաբանում է ներկայացրել լրագրող Արփի Մախսուդյանի գրառման առնչությամբ

ՀՀ ոստիկանությունը պարզաբանում է տարածել Civilnet.am կայքի լրագրող Արփի Մախսուդյանի տանը խուզարկություն անցկացնելու վերաբերյալ:

«Արմենպրես»-ը պարզաբանումը ներկայացնում է ամբողջությամբ.

«Լրագրող Արփի Մախսուդյանը սոցիալական ցանցի իր էջում գրառում է կատարել, թե առավոտ ծեգին ոստիկանությունից չորս ոստիկան մեզ հյուր էին եկել ու ուզում էին տունը խուզարկել․․․ Ըստ Արփի Մախսուդյանի՝ ոստիկաններն առանց համապատասխան որոշման փորձել են իրենց բնակարանում իրականացնել խուզարկություն: Հայտնում ենք, որ ոստիկանության օպերատիվ-հետախուզական ստորաբաժանման  ծառայողների կողմից հոդվածում նշված բնակարանում որևէ քննչական գործողություն, այդ թվում՝ խուզարկություն կատարելու նպատակ չի եղել: Ոստիկանության ծառայողներն իրավունք ունե հանցագործություն կատարելու մեջ կասկածվող անձանց հետապնդելիս հանցագործություն կատարվելու կամ կատարված լինելու,…ինչպես նաև հետաձգում չհանդուրժող այլ դեպքերում մուտք գործելու բնակարաններ, շինություններ, տարածքներ, հողամասեր, այդ թվում` արգելքները վերացնելու միջոցով /«Ոստիկանության մասին» ՀՀ օրենքի 20-րդ հոդված/:

Ոստիկանության ծառայողները բնակարան են մուտք գործել ծանր հանցագործություն կատարելու համար հետախուզվող անձին հայտնաբերելու նպատակով, ունեցել են բնակարան մուտք գործելու՝ օրենքով ամրագրված հիմքեր: Բնակարանում անցկացվել է միայն «օպերատիվ հարցում» օպերատիվ-հետախուզական միջոցառումը, ծառայողները բնակարան մուտք են գործել տան տիրոջ թույլտվությամբ: Հիշյալ գործողությունները կատարելու համար դատարանի որոշում չի պահանջվում: Ոստիկանությունը հորդորում է ծառայողների ենթադրյալ անօրինականությունների վերաբերյալ նյութեր հրապարակելուց ա ռաջ անհրաժեշտ տեղեկություններ ստանալ ՀՀ ոստիկանության հասարակայնության հետ կապի և լրատվության վարչությունից»:
