ՀՀ ԱԱԾ-ն բացահայտել է Իրանի քաղաքացիների կողմից առանց լիցենզիայի արտարժույթի առուվաճառք իրականացնելու դեպքեր

Հայաստանի Հանրապետության կառավարությանն առընթեր ազգային անվտանգության ծառայության կողմից իրականացված մեծածավալ օպերատիվ-հետախուզական միջոցառումների և քննչական գործողությունների արդյունքում բացահայտվել են Իրանի Իսլամական Հանրապետության քաղաքացիների կողմից ապօրինի ձեռնարկատիրությամբ զբաղվելու և առանց լիցենզիայի արտարժույթի առուվաճառք իրականացնելու դեպքեր։

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ ԱԱԾ մամուլի կենտրոնից, ձեռք բերված բավարար ապացույցների համակցությամբ հիմնավորվել է, որ ԻԻՀ երեք քաղաքացի իրանական բանկային համակարգից ձեռք են բերել 6 հատ «Պոստերմինալ», դրանք տեղադրել են Երևան քաղաքի տարբեր հասցեներում վարձակալած տարածքներում և համացանցի միջոցով համակցել իրանական տարբեր բանկերում բացված իրենց հաշվեհամարներին։ Այնուհետև, հիշյալ «Պոստերմինալների» շահագործմամբ փաստացի զբաղվելով ապօրինի ձեռնարկատիրությամբ և առանց լիցենզիայի արտարժույթի առուվաճառքով, 1-5 տոկոս միջնորդագումարի գանձմամբ Իրանից ժամանած գործարարների և զբոսաշրջիկների՝ բացառապես այդ երկրում օգտագործելու համար նախատեսված բանկային քարտերից գումարները փոխանցել են վերոհիշյալ հաշվեհամարներին, իսկ Երևանում հաճախորդներին վճարել դրանց համարժեք ՀՀ դրամ կամ ԱՄՆ դոլար։

ՀՀ ԿԱ ազգային անվտանգության ծառայության քննչական վարչությունում կատարված նախաքննությամբ պարզվել է, որ ՀՀ բանկային համակարգի շրջանցմամբ 2016-2017թթ. ընթացքում հիշյալ եղանակով իրականացվել են շուրջ 580 մլն ՀՀ դրամի գործարքներ։

Նախաքննության ընթացքում մեկ անձ հատուցել է իր գործողություններով պետությանը պատճառած վնասը և քրեական օրենքի խրախուսական նորմի հիման վրա ազատվել ապօրինի ձեռնարկատիրության համար ՀՀ քրեական օրենսգրքի 188-րդ հոդվածով նախատեսված քրեական պատասխանատվությունից։ Նրան մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 188.1-րդ հոդվածի 1-ին մասով (առանց լիցենզիայի արտարժույթի առուվաճառքի իրականացումը), վերջինիս վերաբերյալ քրեական գործը մեղադրական եզրակացությամբ ուղարկվել  է դատարան։

Ձեռք բերված ապացույցների հիման վրա որոշումներ են կայացվել նաև ԻԻՀ ևս երկու քաղաքացու  ՀՀ քրեական օրենսգրքի 188-րդ և 188.1-րդ հոդվածների 1-ին մասերով որպես մեղադրյալ ներգրավելու մասին: Նախաքննությունը շարունակվում է:

Ազգային անվտանգության ծառայությունը նախազգուշացնում է, որ ՀՀ բանկային համակարգը շրջանցելով, առանց հատուկ թույլտվության (լիցենզիայի) լիցենզավորման  ենթակա ձեռնարկատիրական գործունեություն իրականացնելու փորձերը հետայսու ևս կանխվելու են, նմանատիպ դեպքերի նկատմամբ իրականացվելու է մշտական վերահսկողություն։ 

Ծանուցում. Ենթադրյալ հանցանքի համար կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
