ՀՀ տարածք ադրբեջանական խնձորի ներմուծման հանգամանքները պարզելու նպատակով ՀՀ կառավարությանն առընթեր ազգային անվտանգության ծառայության կողմից ձեռնարկված միջոցառումների արդյունքում ստացված տվյալների հիման վրա՝ խոշոր չափերով հարկ չվճարելու դեպքի առթիվ ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի 1-ին մասով հարուցվել է քրեական գործ:

Քրեական գործի նախաքննության ընթացքում տվյալներ են ձեռք բերվել մի խումբ ՀՀ քաղաքացիների կողմից Վրաստանի տարածքից ՀՀ պետական սահմանով գյուղատնտեսական ապրանքներ, այդ թվում՝ ադրբեջանական խնձոր ապօրինի տեղափոխելու վերաբերյալ: Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ գլխավոր դատախազությունից, միաժամանակ ազգային անվտանգության ծառայության աշխատակիցների կողմից ձեռնարկված միջոցների արդյունքում պարզվել է, որ վերը նշված ապրանքները ՀՀ պետական սահմանով տեղափոխվել են առանց մաքսային հսկողության՝ կա շառքի դիմաց մաքսային ծառայողների թողտվությամբ:

Բացի այդ, ՀՀ կառավարությանն առընթեր պետական եկամուտների կոմիտեի իրավախախտումների հայտնաբերման ու վարչական վարույթների իրականացման վարչության հետաքննության բաժնում նյութերի նախապատրաստմամբ ևս պարզվել է, որ մի խումբ քաղաքացիներ ձեռք են բերել և ՀՀ շուկայում իրացրել ադրբեջանական ծագման խնձոր: Նշված նյութերով ևս ձեռք են բերվել տվյալներ այն մասին, որ 2016 թվականի դեկտեմբերից մինչև 2017 թվականի ապրիլն ընկած ժամանակահատվածում ապօրինի ձեռնարկատիրական գործունեություն իրականացնող անձանցից Բագրատաշենի մաքսային կետում ծառայություն իրակ անացնող համապատասխան պաշտոնատար անձինք առանց մաքսազերծման ՀՀ պետական սահմանով մրգերի և բանջարեղենի տեղափոխումը թույլատրելու համար պարբերաբար ստացել են կաշառք:

Ապօրինի ձեռնարկատիրական գործունեություն իրականացնելու և կաշառք ստանալու դեպքերի առթիվ ՀՀ կառավարությանն առընթեր պետական եկամուտների կոմիտեի իրավախախտումների հայտնաբերման ու վարչական վարույթների իրականացման վարչության հետաքննության բաժնում ՀՀ քրեական օրենսգրքի 188-րդ հոդվածի 2-րդ մասով և 311-րդ հոդվածի 1-ին մասով հարուցվել է քրեական գործ:

Նկատի ունենալով, որ նշված քրեական գործերը առնչվում են պետական հատուկ ծառայություն իրականացնող անձանց կողմից առերևույթ կատարված հանցագործություններին, ՀՀ քրեական դատավարության օրենսգրքի 190-րդ հոդվածով սահմանված կարգով, քրեական գործերի նախաքննությունը հանձնարարվել է ՀՀ հատուկ քննչական ծառայությանը: Նախաքննություն իրականացնող մարմնին հանձնարարվել է ձեռնարկել օրենքով նախատեսված բոլոր միջոցները՝ առանց մաքսային հսկողության ՀՀ ներմուծումների դեպքերը, դրանց առնչվող մաքսային ծառայողների հանցավոր գործունեության բոլոր հանգամանքները լիարժեք բացահայտելու ուղղությամբ:
