Ո՞վ է կառավարելու երկիրը կառավարության հրաժարականից հետո եւ որքան ժամանակ

Հայաստանի նոր Ազգային ժողովի առաջին նիստը տեղի կունենա խորհրդարանի ձեւավորվելուց հետո երրորդ հինգշաբթի օրը՝ մայիսի 18-ին. այդ օրը կառավարությունը վայր կդնի իր լիազորությունները, սակայն կշարունակի աշխատել իր բնականոն հունով, մինչեւ նոր կառավարության ձեւավորումը։
ԵՊՀ սահմանադրական իրավունքի ամբիոնի վարիչ, իրավագիտության դոկտոր, պրոֆեսոր, ՀՀ նախագահին առընթեր սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովի անդամ Գեւորգ Դանիելյանը NEWS.am-ի հետ զրույցում նշեց, որ կառավարությունը մայիսի 18-ին ամենայն հավանականությամբ կանցկացնի իր հերթական նիստը, անկախ նրանից, որ այդ օրը վայր է դնում իր լիազորությունները, քանի որ կառավարությունը պետք է շարունակի իր աշխատանքը, մինչեւ նոր կառավարության ձեւավորումը։
Նրա խոսքով, կառավարության բոլոր անդամներն այդ օրը (մայիսի 18-ին) հրաժարականի դիմումներ են ներկայացնում եւ մինչեւ նոր կառավարության ձեւավորումը համարվում են պաշտոնակատարներ։
Ինչ վերաբերում է նոր կառավարության ձեւավորմանը, ըստ օրենսդրության այդ հարցում այս պահին գործում է 2005 թվականին ընդունված Սահմանադրության դրույթները:
Ըստ այդմ, նոր Ազգային ժողովի առաջին նիստի օրը կառավարության լիազորությունները վայր դնելուց հետո 10 օրվա ընթացքում (մինչեւ մայիսի 28-ը) նշանակվելու է նոր վարչապետ: Վարչապետին նշանակելու է ՀՀ նախագահը՝ խորհրդակցելով խորհրդարանական խմբակցությունների հետ: Նախագահը վարչապետ է նշանակում այն անձին, որը վայելում է խորհրդարանի մեծամասնության աջակցությունը:
Վարչապետ նշանակումից հետո 20 օրվա ընթացքում (մինչեւ հունիսի 17-ը) վարչապետի առաջարկությամբ նախագահը նշանակում է նախարարներին: Կառավարությունը կազմավորվելուց հետո եւս 20 օրվա ընթացքում կառավարությունն իր ծրագիրը ներկայացնում է Ազգային ժողովին:
ԱԺ առաջին նիստում պարզ մեծամասնությամբ ընտրվում են ԱԺ նախագահը, ԱԺ նախագահի տեղակալները, հանձնաժողովների նախագահները: Խորհրդարանը հաստատում է հանձնաժողովների թիվն ու իրավասության շրջանակները, որից հետո Ազգային ժողովի նիստն ավարտվում է: Հաջորդ նիստը տեղի կունենա արդեն աշնանային նստաշրջանին:
Նշենք, որ Հայաստանի Ազգային ժողովի լիազորությունները դադարում են նոր Ազգային ժողովի առաջին նիստի օրը:
Հիշեցնենք, որ ԿԸՀ-ն հրապարակել է ԱԺ ընտրությունների արդյունքները, ըստ որոնց՝ ԱԺ են անցնում 4 ուժեր՝ ՀՀԿ-ն, «Ծառուկյան» դաշինքը, «Ելք» դաշինքը եւ ՀՅԴ-ն: Ըստ այդմ, ՀՀԿ-ն կստանա 58 մանդատ, «Ծառուկյան դաշինքը՝ 31 մանդատ, «Ելք» դաշինքը՝ 9 մանդատ եւ ՀՅԴ-ն՝ 7 մանդատ:
