Հանցագործ ընդդիմություն

Ապրիլի 25-ից սկսած, Սահմանդրական դատարանը քննում է «ՀԱԿ-ՀԺԿ» դաշինքի դիմումը, վերջին խորհրդարանական ընտրություններն անվավեր ճանաչելու պահանջով։ Այս մասով ուշագրավ դիտարկումներ է արել դաշինքի առաջնորդներից Արամ Մանուկյանը, հայտարարելով, որ.-«Էս ընտրությունները լեգիտիմ համարող քաղաքական ուժերը մաս են կազմում կազմակերպված հանցագործության»։ Այստեղ իհարկե չենք ծանրանա Սահմանադրական դատարանի գործունեության վրա։ Հայաստանում վաղուց, ոչ ոք ակնկալիք չունի դատարաններից։ Չենք խոսի նաև այն ուժերի մասին, որոնք կամ համագործակցել են իշխանության հետ, կամ հեռակա ընդունել են այդ համագործակցության առաջարկները ՝ այսպես ասած մեսսիջները։
Խնդիրն այն ուժերն են, որոնք իրենց հռչակել են արմատական ընդդիմություն և համարում են, որ այս ընտրություններն իրավաչափ են։ Իրականում, բոլորը գիտեն, որ ապրիլի երկուսին, Հայաստանում իշխանությունը կիրառել է վարչական ռեսուրս, իշխանությունը փող է բաժանել, որոշ դեպքերում ՝ ահաբեկել է մարդկանց։ Այս ամենն իր մեջ պարունակում է քրեական օրենսգրքի մի քանի հոդվածներ ու դրույթներ։ Այսինքն, նման կոպտագույն խախտումներով և համատարած քրեական հանցագործություններով ձևակերպված իշխանությունը համարել լեգիտիմ, նույնն է, որ մաս կազմել հանցագործության։ Շատ դեպքերում, մարդը կարող է կանխել հանցագործություն, բայց դա չի անում։ Կամ տեղի է ունենում հակառակ պրոցեսը, անուղղակի աջակցում է հանցագործությանը կամ ունենալով որոշակի շահադիտական նպատակներ, մաս է կազմում այդ հանցավոր գործողությանը։ Կարծում ենք, այս պարագայում հենց այդ դրվագն է գործում։ Իշխանությանը լեգիտիմ է համարում մի ուժ, որն առավոտից երեկո բարձրաձայնում է Հայաստանում տեղի ունեցող «անօրինականությունները», սակայն մեծ հաշվով տառապում է մանդատացավով։
