Վարչական վարույթների վերաբերյալ ծանուցման համակարգի արդյունավետությունն աճել է

Հարկ վճարողների չկատարած պարտավորությունների գանձման և իրավախախտում կատարած անձանց վարչական պատասխանատվության ենթարկելու վերաբերյալ վարչական վարույթ հարուցելիս, օրենքի պահանջով, պետք է պարտադիր ծանուցել հասցեատիրոջը: Պետական եկամուտների կոմիտեի իրավաբանական վարչության պետ Արման Մնացականյանի տեղեկացմամբ՝ կոմիտեն հետևողական է ծանուցման համակարգի արդյունավետ կիրառման, վեր հանված խնդիրների լուծման ուղղությամբ. «Անպատաս խան չի թողնվում ոչ մի դիմում, իսկ ներկայացված առարկությունների հիմնավորվածության դեպքում՝ տրվում են դրական լուծումներ»: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ ԿԱ ՊԵԿ տեղեկատվության և հասարակայնության հետ կապերի բաժնից:
ՊԵԿ իրավաբանական վարչությունից, սակայն տեղեկացնում են, որ երբեմն տնտեսվարողի պաշտոնատար անձինք չեն մասնակցում վարչական վարույթներին, չնայած մասնակցելու վերաբերյալ պատշաճ ծանուցված լինելուն, այդպիսով չներկայացնելով վարույթների վերաբերյալ առարկություններ կամ պատասխանատվությունը բացառող ապացույցներ: Ըստ Արման Մնացականյանի, արդյունքում վարչական մարմինը ստիպված է լինում վարչական ակտեր կայացնել վարույթներում առկա ապացույցների հիման վրա, մինչդեռ համապատասխան ապացույցներ ներկայացնելու դեպքում հնարավոր է բացառել վարչական ակտի ընդունումը: «Նման իրավիճակներից խուսափելու նպատակով ՊԵԿ-ը վարչական վարույթներին մասնակցելու վերաբերյալ ծանուցագրեր ստացած անձանց հորդորում է ներկայանալ դրանցում նշված հասցեով, մասնակցել իրականացվող վարույթներին և, անհրաժեշտության դեպքում, ներկայացնել առարկություններ` վարչական մարմնին գործի օբյեկտիվ քննություն իրականացնելու հնարավորություն տալով: Ներկայանալու անհնարինության դեպքում կարող են ուղարկել փոստային ծառայությամբ»,-նշել է իրավաբանական վարչության պետը:
Իրավաբանական վարչությունում փաստում են, որ 2015 թվականի համեմատ՝ 2016-ին 40 տոկոսով նվազել է կայացված վարչական ակտերի քանակը, իսկ գանձման որոշումները՝ շուրջ 60 տոկոսով, ինչն, ըստ Արման Մնացականյանի, պայմանավորված է ծանուցումներում քաղաքացիների ներկայացրած առարկություններով տեղ գտած իրավախախտման բացակայության վերաբերյալ հիմնավորումներով:
