Հարկերից խուսափած ընկերությունները հասցրել են սնանկ ճանաչվել. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Օրինախախտ տնտեսվարողների հանդեպ խոշոր չափի լրացուցիչ հարկային պարտավորություն առաջադրելով ՊԵԿ–ը նպատակ ունի հետ բերել չվճարված հարկային գումարները, որոնք այս կամ այն բարձրաստիճան պաշտոնյայի հովանու ներքո գտնվող ընկերությունները ժամանակին կարողացել են «վարպետորեն» թաքցնել:
ՊԵԿ–ին հաջողվել է պարզել, որ ԵԱՏՄ երկրներից ներկրումներով զբաղվող մի շարք ընկերություններ և որոշ տնտեսվարողներ, օգտվելով ներմուծման գործընթացի ազատականացումից և ներկայացնելով խեղաթյուրված տվյալներ փորձել են խուսափել խոշոր չափի հարկային պարտավորություններից:
Բացահայտված մի շարք դեպքերով տնտեսվարողները, թաքցրել են իրացման շրջանառությունը, խուսափել են ԱԱՀ գծով հարկերը վճարելու պարտավորությունից:
Մասնավորապես՝ «Հավիցա» ՍՊԸ–ն, զբաղվելով Ռուսաստանի Դաշնությունից սննդային ձվի, ցորենի և թռչնամսի ներմուծմամբ և իրացմամբ, 2016 թ. ընթացքում հարկային տեսչությանը ներկայացնելով խեղաթյուրված տվյալներ, չի վճարել 28 միլիոն 104 հազար դրամի հարկ:
ՊԵԿ իրավախախտումների հայտնաբերման ու վարչական վարույթների իրականացման վարչության պետ Սամվել Սինանյանի ներկայացմամբ, հետագայում պարզվել է նաև, որ «Հավիցա» ընկերության սեփականատերը այլ անձանց անուններով տարբեր ընկերություններ է ստեղծել, որոնք նույնպես խոշոր ֆինանսական խախտումներով են «աշխատել»:
16 միլիոն 592 հազար դրամի հարկեր վճարելուց խուսափել է նաև «Տեղական» ՍՊԸ–ն, իսկ «Գնդեվազի թռչնաֆաբրիկա»–ն խուսափել է 3 միլիոն 736 հազար դրամի հարկեր վճարելուց: «Անդրե Րենթեր» ՍՊԸ–ՊԵԿ պարտավորությունների ճշգրտման արդյունքում էլ ընկերությունը կանգնել է ավելի քան 73 միլիոն դրամ լրացուցիչ բյուջե վճարելու պարտավորության առջև:
Ուշագրավ է, սակայն, որ նույն «Անդրե Րենթեր» ՍՊԸ–ն անցյալ տարվա դեկտեմբերի 22–ին ՀՀ Կոտայքի մարզի ընդհանուր իրավասության դատարանի վճռով սնանկ է ճանաչվել: Իսկ ավելի վաղ, Արմավիրի մարզի առաջին ատյանի դատարանը նմանատիպ վճիռ է կայացրել «Տեղական» ՍՊԸ–ի մասով:
Եվ այս պայմաններում, երբ տեսականորեն հնարավոր չէ դատարանի վճռով սնանկ ճանաչված ընկերությունից գումար վերադարձնել բյուջե, ՊԵԿ իրավախախտումների հայտնաբերման և վարչական վարույթների իրականացման վարչության հետաքննության բաժնում խոշոր չափերով և առանձնապես խոշոր չափերով հարկերը վճարելուց չարամտորեն խուսափելու առթիվ քրեական գործեր է հարուցել՝ ՀՀ քրեական օրենսգրքի 205–րդ հոդվածի 1–ին և 2–րդ մասերի հատկանիշներով: Ու թեև հարուցվել են քրեական գործեր, սակայն հայտնի չէ, թե այդ գործի շրջանակներում արդյո՞ք հնարավոր կլինի վերականգնել պետությանը պատճառած վնասը, թե դրանք կմնան պատմության էջերում, իսկ սնանկության գործերն էլ, տարիներով կպտտվեն դատարաններում:
