Հստակեցվել են Գլխավոր դատախազի տեղակալների պաշտոնի նշանակման և ազատման հիմքերը

Մրցութային ընթացակարգով կնշանակվեն գլխավոր դատախազի տեղակալները՝ որակավորման հանձնաժողովի կեսից ավելի ձայները ստանալու դեպքում: Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ արդարադատության նախարարության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից, այս մասին մարտի 30-ին Կառավարության նիստին նշել է ՀՀ արդարադատության նախարար Արփինե Հովհաննիսյանը, ներկայացնելով՝  «Դատախազության մասին» ՀՀ օրենքի նախագիծը:

Նախարարի խոսքով՝ հիմնական փոփոխությունները վերաբերում են նոր Սահմանադրությամբ պայմանավորված իրողություններին և կարգավորումներին: «Քանի որ նոր Սահմանադրությամբ գլխավոր դատախազի տեղակալների նշանակման հարցը չի կարգավորվում, ապա այս օրենքը անդրադարձել է այդ հարցին, և նախատեսել Գլխավոր դատախազի տեղակալներին մրցութային ընթացակարգով նշանակելու կարգավորում՝ որակավորման հանձնաժողովի կեսից ավելի ձայները ստանալու դեպքում», - ասել է Արփինե Հովհաննիսյանը:

Հաջորդ էական փոփոխությունը, որ կատարվել է օրենքում վերաբերում է այն հարցին, թե ով պետք է քրեական հետապնդում իրականացնի Գլխավոր դատախազի նկատմամբ, կամ Գլխավոր դատախազին բերման ենթարկելու համար, ընդհանրապես, հնարավորություն  առկա է, թե՝ ոչ:

«Այս տեսանկյունից ևս նախագիծը որոշակի կարգավորումներ է նախատեսել հատկապես, որ Ազգային ժողովի համաձայնությամբ կարող է  քրեական գործ հարուցվել, ինչպես նաև Գլխավոր դատախազը կարող է ազատությունից զրկվել Ազգային ժողովի համաձայնությամբ՝ բացառությամբ օրինական ուժի մեջ մտած դատավճռի հիման վրա ազատությունից զրկելու դեպքերի կամ,  երբ նա բռնվել է հանցանք կատարելու պահին կամ անմիջապես դրանից հետո»,- հավելել է արդարադատության նախարարը:

«Դատախազության մասին» ՀՀ օրենքի նախագծում անդրադարձ է կատարվել նաև  նշանակման ընթացակարգերին, պաշտոնի նշանակման խոչընդոտման հիմքերին, կարգապահական վարույթին, և այլ իրավակարգավորումներին:
