Սամվել Բաբայանին մեղադրանք է առաջադրվել քրեական օրենսգրքի երկու հոդվածով

ԼՂՀ պաշտպանության բանակի նախկին հրամանատար Սամվել Բաբայանին մեղադրանք է առաջադրվել: Սամվել Բաբայանի իրավապաշտպան Ավետիս Քալաշյանը նշեց, որ մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 2-րդ մասի և 235.1 հոդվածի 2-րդ մասի հատկանիշներով։ «Նախաքննությունը նոր է սկսվել և գործը դատարան ուղարկելու համար շատ վաղ է»,- ասաց Քալաշյանը:
ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 2-րդ մասը սահմանում է՝ ապօրինի կերպով հրազեն, բացի ողորկափող հրազենից և դրա փամփուշտներից, ռազմամթերք, ակոսափող հրազենի փամփուշտներ, պայթուցիկ նյութեր կամ պայթուցիկ սարքեր ձեռք բերելը, իրացնելը, պահելը, փոխադրելը կամ կրելը, որոնք կատարվել են մի խումբ անձանց կողմից նախնական համաձայնությամբ: Պատժվում է ազատազրկմամբ՝ երկուսից վեց տարի ժամկետով:
235.1 հոդվածի 2-րդ մասը սահմանում է՝ խիստ ներգործող, թունավոր, պայթուցիկ, ռադիոակտիվ նյութերի, ճառագայթման աղբյուրների, միջուկային նյութերի, հրազենի կամ նրա բաղ կացուցիչ մասերի, բացի ողորկափող որսորդական հրազենից և դրա փամփուշտներից, պայթուցիկ սարքերի, ռազմամթերքի, զանգվածային ոչնչացման զենքի, դրա տեղափոխման միջոցների, այլ զինամթերքի, ռազմական տեխնիկայի, զանգվածային ոչնչացման զենք կամ դրա փոխադրման հրթիռային համակարգեր ստեղծելու համար օգտագործվող այլ նյութերի կամ սարքավորումների, միջուկային, քիմիական, կենսաբանական կամ զանգվածային ոչնչացման այլ զենքի կամ երկակի նշանակության ապրանքների, ռազմավարական տեսակետից կարևոր հումքային ապրանքների կամ մշակութային արժեքների մաքսանենգությունը, որը կատարվել է մի խումբ անձանց կողմից նախնական համաձայնությամբ: Այն պատժվում է ազատազրկմամբ՝ երեքից յոթ տարի ժամկետով՝ գույքի բռնագրավմամբ:
Կենտրոն և Նորք- մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանը երեկ Սամվել Բաբայանին 2 ամսով կալանավորելու որոշում էր կայացրել։ Սամվել Բաբայանը չի ընդունում իրեն առաջադրված մեղադրանքը:
Սամվել Բաբայանը ձերբակալվել է մարտի 22-ին: ՀՀ Ազգային անվտանգության ծառայության հաղորդմամբ, մաքսանենգ եղանակով Հայաստանի Հանրապետություն «Իգլա» տեսակի զենիթա-հրթիռային համալիր տեղափոխելու փաստի առթիվ հարուցված քրեական գործի շրջանակներում այս պահին ձերբակալված են 3 անձ, այդ թվում՝ ՀՀ քաղաքացի Սամվել Բաբայանը. «Կատարված քննչական գործողությունների և օպերատիվ-հետախուզական միջոցառումների արդյունքում ստացվել են նաև արժանահավատ տվյալներ, որ նշված զենիթա-հրթիռային համալիրի բաղկացուցիչ մասերի ձեռքբերումը և փոխադրումն իրականացրած անձինք գործել են Սամվել Բաբայանի հետ ունեցած նախնական համաձայնությամբ և նրա պատվերով»։
