Սահմանվում են բուժման նպատակով օտարերկրյա պետությունում գտնվող զինծառայողների կենսաթոշակի իրավունքի իրացման նոր պայմաններ

ՀՀ աշխատանքի և սոցիալական հարցերի նախարար Արտեմ Ասատրյանի ներկայացմամբ ՀՀ կառավարության 09.03.2017թ. հերթական նիստում հավանության է արժանացել «Պետական կենսաթոշակների մասին» Հայաստանի Հանրապետության օրենքում փոփոխություններ և լրացումներ կատարելու մասին» ՀՀ օրենքի նախագիծը:
Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության հասարակայնության հետ կապերի բաժնից, նախագծով առաջարկվում է, որ բուժման նպատակով օտարերկրյա պետությունում գտնվող` Հայաստանի Հանրապետության պաշտպանության մարտական գործողություններին մասնակցելու կամ մարտական հերթապահություն կամ հատուկ առաջադրանք կատարելու, կամ ծառայողական պարտականությունները կատարելու ժամանակ ստացած վնասվածքի կամ խեղման` զինվորական ծառայության հետ հաշմանդամության պատճառական կապ ունեցող անձին.
1) կենսաթոշակ նշանակելու կարգը սահմանում է Հայաստանի Հանրապետության կառավարությունը:
Գործող ընդհանուր կարգի համաձայն` կենսաթոշակ նշանակվում է, երբ դիմումն ու անհրաժեշտ փաստաթղթերը քաղաքացին ներկայացնում է անձամբ: Նախագիծն ընդունվելու դեպքում կնախատեսվի երրորդ անձի միջոցով դիմումն ու անհրաժեշտ փաստաթղթերը ներկայացնելու հնարավորություն,
2) կենսաթոշակ վճարելը վերսկսվում է լիազորագրով:
Ըստ գործող ընդհանուր կարգի` կենսաթոշակ վճարելը լիազորագրով վերսկսվում է միայն, երբ կենսաթոշակառուն պատիժը կրում է քրեակատարողական հիմնարկում կամ բուժվում է հոգեբուժական հաստատությունում,
3) կենսաթոշակ ստանալու իրավունքը վերականգնելու և կենսաթոշակ վճարելը վերսկսելու առանձնահատկությունները սահմանում է Հայաստանի Հանրապետության կառավարությունը:
Գործող ընդհանուր կարգի համաձայն` կենսաթոշակ ստանալու իրավունքը վերականգնելու և կենսաթոշակ վճարելը վերսկսելու համար դիմումն ու անհրաժեշտ փաստաթղթերը քաղաքացին ներկայացնում է անձամբ:
