Սիմոն Բաբայանն իրավական տեսանկյունից կասկածելի է համարում Լապշինին արտահանձնելու որոշումը

Իրավական տեսանկյունից ճանապարհորդ, բլոգեր Ալեքսանդր Լապշինի արտահանձնման որոշումը կարգավորվում է Իրավական փոխօգնության մասին քիշնևյան կոնվենցիայով, Բելառուսի քրեական դատավարության օրենսգրքով: «Արմենպրես»-ի հաղորդմամբ` հունվարի 21-ին լրագրո ղների հետ հանդիպման ժամանակ այս մասին նշեց Փաստաբանների պալատի անդամ Սիմոն Բաբայանն` ընդգծելով, որ, Կոնվենցիայի համաձայն, այս արտահանձնումն իրավաչափ չէ:
Փաստաբանի խոսքով` կոնվենցիան ունի հստակ դրույթներ այն մասին, որ անձը չի կարող իր քաղաքական հայացքների համար հետապնդվել:
Սիմոն Բաբայանը շեշտեց, որ Ադրբեջանի քրեական օրենսգրքի համաձայն՝ Լապշինի կողմից սահմանահատումը կդիտարկվեր որպես հանցանք, եթե նա հատած լիներ Ադրբեջանի կողմից պահպանվող սահմանը, այնինչ Լապշինը հատել է Ադրբեջանի իշխանությունների կողմից չպահպանվող սահմանի տարածքը, և Լեռնային Ղարաբաղի Հանրապետությունը երբեք չի կարող դիտարկվել որպես Ադրբեջանի Հանրապետության տարածք:
«ՌԴ-ի և Բելառուսի միջև կա «Միութենական պետություն» ստեղծելու մասին պայմանագիր, որի համաձայն՝ երկու պետությունների քաղաքացիները օգտվում են հավասարազոր իրավունքներից, և նրանց իրավունքերը չեն կարող նսեմացվել»,-ասաց Բաբայանը և հավելեց, որ, հաշվի առնելով այդ պայմանագիրը, Բելառուսի դատախազության կողմից կայացրած որոշումը կասկածելի է, իսկ իրավական տեսանկյունից` խնդրահարույց:
Մինսկի ոստիկանությունը 2016 թվականի դեկտեմբերի 15-ին ձերբակալել է Լապշինին, ով բնակվում է Մոսկվայում և գրում է ռուսերեն հեղինակավոր Travel Blog-ի համար: Նա որոնվում է Ադրբեջանում 2011 թվականի ապրիլին, 2012 թվականի հոկտեմբերին և 2016 թվականի հունիսին Լեռնային Ղարաբաղ այցելելու, ինչպես նաև իր բլոգում Ադրբեջանի քաղաքականությունը քննադատելու համար: Ադրբեջանը 2011 թվականին նրան ներառել էր իր կողմից որոնվող անձանց ցուցակում: Բաքուն պահանջում է Բելառուսի իշխանություններից Լապշինին արտահանձնել իրենց:
