Ինչու՞ Հայաստանը Թուրքիայից չի պահանջում ապահովել իր՝ դեպի ծով ելքի իրավունքը

Անկախության 25 տարիների ընթացքում ՀՀ արտաքին քաղաքական օրակարգում երբևէ Թուրքիայի նկատմամբ պաշտոնապես պահանջ չի ներկայացվել Հայաստանին տրամադրել ելք դեպի Սև կամ Միջերկրական ծով։ Սա ոչ թե քաղաքական, այլ իրավական պահանջ է, որը մեզ համար կենսական նշանակություն ունի։ Այո՛, Թուրքիան չի վավերացրել «Դեպի ծով ելք չունեցող պետությունների տարանցիկ առևտրի մասին» ՄԱԿ կոնվենցիան, սակայն վավերացրել է «Տարանցման ազատության մասին Բարսելոնայի 1921թ. կոնվենցիան և ստատուտը» համաձայն որի՝ մասնակից պետությունները պարտավորվում են ապահովել միմյանց տարածքով այլ մասնակից պետությունների ուղեբեռի և ապրանքների, ինչպես նաև նավերի, ուղևորատար և ապրանքատար կազմի և տրանսպորտային մյուս միջոցների ազատ տարանցումը:

Հայաստանը պետք է քաղաքական պահանջ ներկայացնի Թուրքիային՝ իր այս իրավունքի ապահովման համար, իսկ պահանջի չբավարարման դեպքում Հայատանը պետք է դիմի Արդարադատության միջազգային դատարան՝ խնդիրը բերելով միջազգային իրավական դաշտ։ Նշեմ որ, փայլուն օրինակ է Բոլիվիան ընդդեմ Չիլիի գործը, որն արդեն իսկ քննվել է Արդարադատության միջազգային դատարանի կողմից և Բոլիվիան դեպի ծով ելքի իրավունք է ստացել։

Պատկերն ամբողջական դարձնելու համար նշեմ, որ Աստված մեզ Levon Gevorgyan-ի, Եղիշե Կիրակոսյանի, Vladimir Vardanyan -ի և այլոց նման միջազգային իրավունքի գիգանտներ է տվել ու չի խնայել։
