Կառավարությունն ընդունեց «բիզնեսի ապաքրեականացմանն» ուղղված օրենսդրական նախագիծը

ՀՀ կառավարությունը հաստատեց «ՀՀ քրեական օրենսգրքում փոփոխություններ կատարելու մասին» օրենքի նախագիծը: ՀՀ արդարադատության նախարար Արփինե Հովհաննիսյանը նշեց, որ ՀՀ գործող քրեական օրենսգրքի 205-րդ հոդվածի դիսպոզիցիայի կիրառման պայմաններում գործնականում առաջանում են մի շարք իրավական խնդիրներ, մասնավորապես, դիսպոզիցիայում առկա են հասկացություններ, որոնց կիրառությունը գործնականում առաջացնում է բ արդություններ, մասնավորապես՝ «չարամտորեն խուսափել» և «խեղաթյուրված տվյալներ» հասկացությունները: Ըստ նախարարի, իրավակիրառողների համար բավականին դժվարություն է առաջանում ապացուցել, օրինակ, թե որ դեպքերում է տնտեսվարող սուբյեկտի կողմից հարկը, տուրքը կամ պարտադիր այլ վճարը չվճարելը համարվում չարամտորեն խուսափել, իսկ չվճարելու որ դեպքն իր մեջ չարամտություն չի պարունակում:

«Գործնականում իրավակիրառողների համար դժվարություն է առաջանում նաև «խեղաթյուրված տվյալներ» գնահատողական հասկացության ապացուցումը, քանի որ շատ դեպքերում անհնար է համարժեք քրեաիրավական գնահատական տալ գործում առկա փաստերին, արդյո՞ք ներկայացված տվյալը խեղաթյուրված է, թե ոչ՝ հաշվի առնելով, որ օրենքում հստակեցված չեն տվյալը խեղաթյուրված համարելու օրենսդրական սահմանները»,- «Արմենպրես»-ի փոխանցմամբ, ասաց Հովհաննիսյանը՝ ավելացնելով, որ նախագծով առաջարկվում է ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի դիսպոզիցիայի նոր խմբագրություն, որի արդյունքում՝ հստակեցվում են հանցագործության եղանակները, վերանայվում է խոշոր չափի նվազագույն շեմը և գործնականում ապահովվում է նորմի որոշակիությունը:

Նախագծով վերանայվել է ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի 3-րդ մասում խոշոր չափի նվազագույն շեմը, արդյունքում՝ հանցագործության պահին սահմանված նվազագույն աշխատավարձի երկուհազարապատիկի (2.000.000 ՀՀ դրամ) փոխարեն առաջարկվել է սահմանել նվազագույն աշխատավարձի չորսհազարապատիկը (4.000.000 մլն ՀՀ դրամ): Առաջարկվել է նաև հստակեցնել ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի նպատակը՝ հարկը, տուրքը կամ պարտադիր այլ վճարը խոշոր չափերով չվճարելը:

Վարչապետ Կարեն Կարապետյանը հետաքրքրվեց՝ կարո՞ղ է ասել, հասկանալ, որ այս փոփոխությունները գործարար աշխարհի կյանքը թեթևացնում են, արդյոք այն ուղղված է բիզնեսի ապաքրեականացմանը:

«Միանշանակ: Կարող ենք այդպիսի փաստում անել պարոն վարչապետ, սա ուղղված է գործարար միջավայրի առավել բարելավմանը և այս նախագիծը նրանց հետ տևական ժամանակ քննարկվել է և նրանց մտահոգությունները զգալիորեն փարատում է»,- ընդգծեց Արդարադատության նախարարը:
