ՄԻԵԴ-ում Սիսի կաթողիկոսարանի կալվածքների վերադարձի հայցի քննումը կարող է տևել 4-5 տարի

Սիսի կաթողիկոսարանի կալվածքների վերադարձի խնդրով Մարդու իրավունքների եվրոպական դատարան ներկայացված հայցի քննարկումն ու վերջնական որոշման ընդունումը կարող է տևել մի քանի տարի: Այս մասին Բրյուսելում հրավիրված մամուլի ասուլիսի ժամանակ հայտարարել է գործի փաստաբան Փայամ Ախավանը, ով միջազգային իրավունքի մասնագետ է և Մոնրեալի ՄըքԳիլ համալսարանի պրոֆեսոր:
«Մարդու իրավունքների եվրոպական դատարանը տարեկան քննում է տասնյակ հազարավոր գործեր: Հաշվի առնելով դատարանի զբաղվածությունը` կարծում ենք, որ մեր դիմումի քննարկումը և որոշման ընդունումը կարող է տևել 4-5 տարի: Սակայն մենք արդարության հաստատման համար սպասել ենք 100 տարի, հետևաբար կարող ենք սպասել ևս 4-5 տարի»,- նշել է փաստաբանը:
Անդրադառնալով գործի պատմությանը` նա ընդգծել է, որ Մեծի Տանն Կիլիկիո Արամ Ա կաթողիկոսը երկու անգամ` 2011 և 2013 թվականներին հատուկ նամակով դիմել է այն ժամանակ Թուրքիայի վարչապետ Ռեջեփ Թայիփ Էրդողանին` պահանջելով վերադարձնել Սիսի կաթողիկոսարանի կալվածքը, սակայն նրա դիմումներն անպատասխան են մնացել: Ավելի ուշ, երբ գործը հանձնվել է Թուրքիայի Սահմանադրական դատարան, վերջինս որոշել է անգամ ընթացք չտալ գործին: Փաստաբանը պատմել է, որ Թուրքիայում ամեն կերպ չի թույլատրվել և արգելվել է Սիսի կաթողիկոսարանի սեփանաության փաստաթղթերի ուսումնասիրությո ւնը: «Մեզ չեն թույլատրել տեսնել, թե ինչպես է այն գրանցված: Հավատցած եմ, որ արգելել են, քանի որ թաքցնելու բան ունեն»,- ընդգծել է նա:
Փայամ Ախավանը, պատասխանելով ներկա եգիտացի լրագրողի հարցին, թե արդյոք կարող է Եվրամիության և Թուրքիայի միջև հարաբերությունները, պայմանավորված նաև փախստականների հարցով, բացասաբար ազդել գործի ընթացքի վրա` համոզմունք է հայտնել, որ քաղաքական խնդիրները տվյալ գործի վրա ազդեցություն չեն թողնի: Փաստաբանը հիշեցրել է նաև, որ Թուրքիան մինչ օրս կատարել է իր վերաբերյալ ՄԻԵԴ կայացրած որոշումները:
«Այս գործը յուրահատուկ կարևորություն ունի: Փաստարկները, որոնք դրված են դատարանի առջև, մեծ հարցերի պատճառ են դառնալու: Թուրքիայի կառավարության շահերից է բխելու լուծել խնդիրը, նախքան դա կանի դատարանը», - համոզմունք է հայտնել Ախավանը:
