ՄԻԵԴ-ի որոշումներից բխող ֆինանսական փոխհատուցումը պետք է վճարի ոչ թե ՀՀ-ն, այլ օրինազանցության հեղինակ չինովնիկը, դատավորը

Հայաստանը, լինելով Եվրոպայի խորհրդի անդամ երկիր, ենթարկվում է ՄԻԵԴ-ի որոշումներին: Որոշումները պարտադիր իրավական ուժ ունեն, և խնդրո առարկա պետությունները պարտավոր են ենթարկվել դրանց:
Հաշվի առնելով երկրում առկա խնդիրների չափն ու բնույթը, արդարադատության ու արդար դատաքննության իրականացման ոլորտում առկա խնդիրների, կոռուպցիայի ծավալները դատական ու որոշ այլ ոլորտներում, մարդու/քաղաքացու իրավունքների խախտումները՝ Հայաստանից ՄԻԵԴ բազմաթիվ դիմումներ են գնում: Ես չեմ կարող ասել, թե այնտեղ ներկայացված դիմումների որ տոկոսն է դրական լուծում ստանում, սակայն պարբերաբար մամուլում տարածվում են նյութեր, թե այս կամ այն քաղաքացու գործով ՀՀ-ն պարտավոր է այսքան մուծում անել հօգուտ քաղաքացու: Խոսքը հազարավոր, երբեմն անգամ տասնյակ հազարավոր եվրո գումարների մասին է: Ու պետությունը դա պետք է վճարի թերացած, սխալ որոշում կայացրած կամ իր պարտականություններն անբարեխղճորեն կատարած չինովնիկի փոխարեն մեր բոլորի վճարած հարկերից ձևավորված բյուջեից:
Ստացվում է, որ մենք հարկեր ենք մուծում, որ պետության անվտանգության ու զարգացման համար միջոցներ գոյանան, մինչդեռ ինչ-որ մի չինովնիկ մասնագիտական իր անգրագիտության կամ անձնական նկրտումներից ելնելով խախտում է քաղաքացու իրավունքները, որի արդյունքում պետությունը ֆինանսական տույժեր է մուծում նրա փոխարեն: Այսինքն՝ մենք բոլորս նրա սխալի փոխարեն վճարում ենք: Արդա՞ր է, կարծում եմ՝ ոչ:
Իրավունքի տեսանկյունից տրամաբանական է, որ հենց պետությունն է կրում այդ չինովնիկների նկատմամբ պատասխանատվությունը, ուստի պետք է հնարավորինս խիստ պատժի վերջինիս: Միաժամանակ ֆինանսական հարցում, կարծում եմ, կարելի է ու պետք է որոշակի ճշգրտումներ արվեն. այսինքն՝ սխալ որոշմամբ պայմանավորված ֆինանսական տույժը պետության փոխարեն պետք է վճարի հենց չինովնիկը, դատավորը, անբարեխիղճ պաշտոնյան իր գրպանից: Այս պարագայում քաղաքացու իրավունքը խախտելուց առաջ վերջինս երկար կմտածի, քանի որ դա լուրջ, այդ թվում՝ ֆինանսական հետևանքներ կունենա հատկապես հենց իր վրա:
Պատերազմող երկրում մենք հարկ չեն վճարում, որ պետությունն այդ գումարից վճարի անբարեխիղճ չինովնիկի սխալների համար:
