Սյունիքի մարզի ընդհանուր իրավասության դատարանում Դավիթ Սարգսյանի նախագահությամբ ավարտվել է Արման Հ.-ի գործի դատական քննությունը:

33-ամյա Արմանը մեղադրվել է տուժողի առողջությանը դիտավորությամբ ծանր վնաս հասցնելու համար՝ ՀՀ քրեական օրենսգրքի 112 հոդվածի 1-ին մասով:

Տուժողը Արմանի կինն է, նրա երկու մանկահասակ երեխաների մայրը:

Ըստ մեղադրանքի՝ 2016 թվականի մարտի 7-ին, ժամը 13-ի սահմաններում Արման Հ.-ն տանը, տեղեկանալով, որ մայրն ու կինը կենցաղային հարցերի շուրջ վիճել են իրար հետ, զայրացել է կնոջ վրա:

Նա խոհանոցում ոտքով երկու անգամ հարվածել է աթոռին նստած կնոջ որովայնին: Կինը դուրս է փախել:

Արմանը հետապնդել է կնոջը, հասել է նրան տնամերձ այգում ու քարով մեկ անգամ դարձյալ հարվածել է կնոջ որովայնին:

Հարվածների հետևանքով կնոջ մոտ առաջացել է օրգանի կորուստ՝ «որովայնի փակ վնասվածք, փայծաղի պատռվածք, ներքին արյունահոսություն»:

Կինը տեղափոխվել է հիվանդանոց, որտեղ կատարվել է որովայնահատում, հեռացվել է փայծաղը:

Դատարանում Արման Հ.-ն իրեն լիովին մեղավոր է ճանաչել, նրա միջնորդությամբ գործը քննվել է արագացված ընթացակարգով:

Տուժող կինը հայտնել է, թե հաշտվել է ամուսնու հետ, նրանից որևէ պահանջ չունի:

Դատարանը հաշվի է առել, որ Արման Հ.-ն ունի մտավոր առողջության խնդիրներ, ինչի համար նա ժամանակին ազատվել է պարտադիր զինվորական ծառայությունից:

Արմանը բանվորություն է անում ու պահում է հինգ հոգուց բաղկացած ընտանիքը: Նրա և տուժողի համատեղ ամուսնական կյանքի ընթացքում 2010 և 2011 թվականներին ծնվել է երկու երեխա:

Ըստ համապատասխան տեղեկանքների՝ Արման Հ.-ի ընտանիքը սոցիալապես անապահով է, ստանում է աղքատության ընտանեկան նպաստ:

Ընտանիքի միակ կերակրողը Արման Հ.-ն է:

Դատարանը հաշվի է առել, որ կնոջը ծանր վնասվածք պատճառելուց անմիջապես հետո Արմանը կնոջը տեղափոխել է հիվանդանոց, զբաղվել է նրա խնամքով: Կինը ներել է նրան, շարունակել է ապրել նույն ընտանիքում:

Նախաքննության ընթացքում Արման Հ.-ն կալանքի տակ է եղել միայն երկու օր, դատարանը մերժել է նրան երկու ամսով կալանքի տակ առնելու միջնորդությունը:

Դատարանն արձանագրել է, որ Արմանի կողմից ազատազրկման ձևով պատիժը իրապես կրելու դեպքում ընտանիքը կհայտնվի առավել ծանր սոցիալական վիճակում:

Արման Հ.-ն մեղավոր է ճանաչվել կնոջ առողջությանը դիտավորությամբ ծանր վնաս պատճառելու համար՝ ՀՀ քրեական օրենսգրքի 112 հոդվածի 1-ին մասով, դատապարտվել է 3 տարի ազատազրկման, նրա նկատմամբ կիրառվել է պայմանական դատապարտություն, և սահմանվել է 3 տարի փորձաշրջան:
