Վերաքննիչ քրեական դատարանի վարույթում է Գրիգոր Տ.-ի գործով բերված վերաքննիչ բողոքի քննությունը:

Գործը քննվել է Տավուշի մարզի ընդհանուր իրավասության դատարանում Սամվել Մարդանյանի նախագահությամբ:

20-ամյա Գրիգորը մեղադրվում էր ծանր հանցագործության կատարման վերաբերյալ սուտ մատնություն կատարելու համար՝ ՀՀ քրեական օրենսգրքի 333 հոդվածի 2-րդ մասի 1-ին կետով:

Ըստ դատական ակտի՝ Գրիգորը եղել է զինծառայող՝ ջոկի հրամանատար, կոչումով՝ ավագ սերժանտ:

Նա, գիտակցելով, որ իր տրամադրած տեղեկությունը սուտ է, 2015 թվականի հոկտեմբերի 8-ին հաղորդում է տվել, թե իրենց զորամասի զինծառայող, ավագ լեյտենանտ Արթուր Շ.-ն 2015 թվականի օգոստոսից մինչև հոկտեմբեր համածառայողների շրջանում իր մասին անվանարկող տեղեկություններ հրապարակելու սպառնալիքով՝ իբր ինքը իրավապահների հետ համագործակցող՝ «գործ տվող» է, 3 անգամ, համապատասխանաբար՝ 90 հազար դրամի, 100 հազար դրամի և 4 հազար դոլարի, ընդհանուրը՝ 2 միլիոն 82 հազար 600 դրամի պահանջ է ներկայացրել իրեն՝ շորթում է կատարել:

Գրիգորի հաղորդումը չի հաստատվել, նա մեղադրվել է սուտ մատնության համար:

Ընդհանուր իրավասության դատարանում Գրիգորն իրեն մեղավոր է ճանաչել: Նրա միջնորդությամբ գործը քննվել է արագացված ընթացակարգով:

Դատարանը հաշվի է առել, որ Գրիգորը զղջում է կատարածի համար, նա հաշտվել է տուժողի Արթուր Շ.-ի հետ, վերջինս բողոք կամ պահանջ չի ներկայացրել:

Գրիգոր Տ.-ն մեղավոր է ճանաչվել մեղսագրված արարքի համար և դատապարտվել է 1 տարի ազատազրկման: Պատժի սկիզբը պետք է հաշվվի Գրիգորին փաստացի կալանքի տակ առնելու պահից, երբ դատավճիռն օրինական ուժ ստանա:

Այս դատավճռի դեմ վերաքննիչ բողոք է ներկայացրել Գրիգոր Տ.-ի շահերի պաշտպանը՝ խնդրելով պատժի մասով բեկանել և փոփոխել դատավճիռը, Գրիգորի նկատմամբ կիրառել պայմանական դատապարտություն, սահմանել փորձաշրջան, նրան իրական ազատազրկման չդատապարտել:
