«Հոկտեմբերի 2-ի Գյումրու ավագանու ընտրություններին Ազգային ժողովի գյումրեցի պատգամավորներից մասնակցում էր միայն Հովհաննես Մարգարյանը: Վերջինիս կողմից գլխավորվող «Հայկական վերածնունդ» կուսակցությունը հաղթահարեց ավագանու ընտրությունների անցողիկ շեմը և ստացավ ավագանու անդամի 4 մանդատ, որոնցից մեկը բաժին հասավ պատգամավոր Հովհաննես Մարգարյանին: Սակայն Հ. Մարգարյանը ընտրություններից ավելի քան մեկ ամիս անց չի հրաժարվել ո՛չ Ազգային ժողովի պատգամավորի, ո՛չ էլ Գյումրու ավագանու անդամի մանդատից, թեև օրենքով այդ երկու պաշտոնները անհամատեղելի են: Այսպես՝ համաձայն ՀՀ Սահմանադրության (Հոդված 65) և «Ազգային ժողովի կանոնակարգ» օրենքի (Հոդված 9.1). Պատգամավորը չի կարող զբաղվել ձեռնարկատիրական գործունեությամբ, զբաղեցնել պաշտոն պետական կամ Տեղական ինքնակառավարման մարմիններում կամ առևտրային կազմակերպություններում, կատարել այլ վճարովի աշխատանք, բացի գիտական, մանկավարժական և ստեղծագործական աշխատանքից: Համաձայն «Տեղական ինքնակառավարման մասին» ՀՀ օրենքում շեշտվում է, որ Համայնքի ավագանու անդամի լիազորությունները վաղաժամկետ դադարեցվում են, եթե նա ավագանու անդամության հետ անհամատեղելի պաշտոն է զբաղեցնում (Հոդված 21.6), իսկ այս դրույթին նախորդող հոդվածում մանրամասնվում է, որ Համայնքի ավագանու անդամը պարտավոր է անհամատեղելի պաշտոններում ընտրվելու կամ նշանակվելու դեպքում անհապաղ գրավոր տեղյակ պահել ավագանուն կամ համայնքի ղեկավարին (Հոդված 20.5): Հովհաննես Մարգարյանն ավագանի ընտրվելուց հետո չի հրաժարվել Ազգային ժողովի պատգամավորի պաշտոնից, այսինքն ավագանու հետ անհամատեղելի պաշտոնում է զբաղեցնում ու դրա մասին ավագանուն և համայնքի ղեկավարին չի տեղեկացրել: Այդպիսով՝ Ազգային ժողովի պատգամավոր Հովհաննես Մարգարյանը, ում պարտականությունն է լինել օրենքի պաշտպան, խախտում է օրենք՝ զբաղեցնելով և՛ պատգամավորի, և՛ ավագանու անդամի պաշտոններ: Պատգամավորն իր իսկ տիպիկ ձևակերպմամբ հայտնվել է «Բուրիտանյան ավանակի» կարգավիճակում՝ երկու դեզերի արանքում չի կողմնորոշվում, թե որ դեզին մոտենա»»,–գրում է թերթը։
