Խոշոր չափերով հարկերը վճարելուց չարամտորեն խուսափելու դեպքի առթիվ ՀՀ ԿԱ պետական եկամուտների կոմիտեի իրավախախտումների հայտնաբերման ու վարչական վարույթների իրականացման վարչության հետաքննության բաժնում քրեական գործ է հարուցվել: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ ԿԱ ՊԵԿ տեղեկատվության և հասարակա յնության հետ կապերի բաժնից:
Կենտրոնի հարկային տեսչությունից ստացված փաստաթղթերի հիման վրա նախապատրաստված նյութերի շրջանակում պարզվել է, որ մայրաքաղաքի Մոսկովյան 35 հասցեում «Կա ընդ Ակ» ՍՊ ընկերությունը կառուցել է բազմաբնակարան շենք, որի բոլոր միավորներն օտարել է Հայաստանում պետական գրանցում չունեցող օտարերկրյա իրավաբանական անձ հանդիսացող 3 ընկերության: Դրանք են «Ակ ընդ Ակ Բիլդինգ Թեքնոլոջիս Լիմիթեդ»-ը, «ԱԻԳ»-ը և «Լասկեդ Լիմիթեդ»-ը: Հետագայում ընկերություններից մեկը օֆշորային գոտի հանդիսացող Բրիտանական Վիրջինյան կղզիներում գրանցված &la quo;Ակ Ընդ Ակ Բիլդինգ Թեքնոլոջիս Լիմիթեդ» ընկերությունն այդ բազմաբնակարան շենքից բնակարաններ և ավտոկայանատեղիներ է վաճառել, սակայն դրանցից բխող հարկային պարտավորությունների մասով հարկային տեսչություն չի ներկայացրել համապատասխան հաշվարկ-հաշվետվություններ և չի կատարել հարկային պարտավորությունները:
«Չհաշվարկած և պետական բյուջե չվճարված հարկային պարտավորությունների վերաբերյալ կատարված նախնական հաշվարկի համաձայն՝ ընկերության հարկային պարտավորությունները ԱԱՀ-ի և շահութահարկի գծով՝ առանց տույժերի և տուգանքների, կազմել են 251.065.000 դրամ»,-տեղեկացնում է ՊԵԿ իրավախախտումների հայտնաբերման ու վարչական վարույթների իրականացման վարչության պետ Սամվել Սինանյանը:
ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի 2-րդ մասի հատկանիշներով հարուցված քրեական գործն ուղարկվել է ՊԵԿ քննչական վարչություն՝ նախաքննություն իրականացնելու համար: Նշենք, որ 205-րդ հոդվածի 2-րդ մասի համաձայն՝ հարկերը, տուրքերը կամ պարտադիր այլ վճարումները վճարելուց չարամտորեն խուսափելը պատժվում ազատազրկմամբ` հինգից տասը տարի ժամկետով` գույքի բռնագրավմամբ, եթե արարքը կատարվել է առանձնապես խոշոր չափերով: Միևնույն ժամանակ 189-րդ հոդվածի 5-րդ մասը նախատեսում է խրախուսական նորմ, որի համաձայն՝ 205-րդ հոդվածով նախատ եսված արարքները կատարած անձն ազատվում է քրեական պատասխանատվությունից, եթե նա հատուցում է հանցագործությամբ պատճառված վնասը և հաշվարկված տույժերն ու տուգանքները:
