Ավան և Նոր Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում Սերգեյ Մարաբյանի նախագահությամբ կայացավ Սրբուհի և Արշակ Ժ.-երի գործով դատական նիստը:

Ամբաստանյալները մայր ու որդի են:

Նրանք գտնվում են կալանքի տակ ու մեղադրվում են ծանր հանցագործությունների՝ դիտավորյալ սպանության և ավազակային հարձակման համար՝ ՀՀ քրեական օրենսգրքի 104 հոդվածի 2-րդ մասի 8-րդ և 175 հոդվածի 2-րդ մասի 1-ին կետերով:

Ըստ մեղադրանքի՝ Սրբուհին որդու՝ Արշակի հետ պայմանավորվել է գողություն կատարել իրենց ծանոթ Բարկիֆի բնակարանից: Միաժամանակ մայր ու որդի նախատեսել են, որ տանտիրոջ կողմից նկատվելու դեպքում գույքի հափշտակություն կկատարեն ավազակային հարձակմամբ: Մայր ու որդի նախնական համաձայնությամբ կատարել են դերաբաշխում:

2016 թվականի փետրվարի 20-ին, ժամը 00.30-ի սահմաններում Սրբուհին ու Արշակը գնացել են Ավան-Առինջ թաղամասում բնակվող Բարկիֆ Յակուբյանի բնակարան:

Այնտեղ մայր ու որդի ընթրել են, ալկոհոլ են օգտագործել:

Ըստ մեղադրանքի՝ Սրբուհին տանտիրոջ հետ փոխադարձ համաձայնությամբ սեքսուալ գործողություններ է կատարել, ինչից հետո տանտեր Յակուբյանը մերկ վիճակում մտել է լոգարան:

Արշակը գնացել է նրա հետևից, հարվածել է Յակուբյանի ծոծրակին ու պարանոցից բռնած՝ տարել է զուգարան, որտեղ երեք անգամ ուժգին հարվածել է Յակուբյանի գլխին:

Այդ ընթացքում Սրբուհին Յակուբյանի բնակարանից հափշտակել է տարբեր իրեր:

Արշակը վնասվածքներ ստացած Յակուբյանին անօգնական վիճակում թողել է զուգարանում, անջատել է լույսը, հյուրասենյակից հափշտակել է մազ կտրելու էլեկտրական ածելին ու հեռացել է:

Բարկիֆ Յակուբյանը ստացած վնասվածքներից նույն օրը գիտակցության չգալով՝ մահացել է:

Դատական նիստին չէին ներկայացել ամբաստանյալների շահերի պաշտպան, հանրային պաշտպանի գրասենյակի փաստաբան Վ. Մակյանը և տուժողի իրավահաջորդը:

Մեղադրողն առաջարկեց հարցում կատարել՝ ստուգելու համար՝ տուժողի իրավահաջորդը հատե՞լ է ՀՀ սահմանը, քանի որ նա ծանուցագրերը չի ստանում:

Ամբաստանյալների շահերի պաշտպան Վ. Մակյանը գրավոր տեղեկացրել էր, որ դատարան չի ներկայանալու:

Ամբաստանյալ Սրբուհի Ժ.-ն էլ հայտարարեց, թե ցանկանում է, որ իրենց շահերը պաշտպանի հանրային պաշտպանի գրասենյակի մեկ ուրիշ փաստաբան: Նա տվեց իր նախընտրած փաստաբանի անուն-ազգանունը: Սակայն նախագահողը բացատրեց, որ ամբաստանյալները չեն կարող ընտրել, թե հանրային պաշտպանի գրասենյակի կոնկրետ որ փաստաբանը պաշտպանի իրենց շահերը: Նրանք, եթե ունեն նյութական հնարավորություն, կարող են փաստաբանի ծառայություններից օգտվել պայմանագրային հիմունքներով՝ այդ դեպքում կարող են կատարել փաստաբանի ընտրություն:

Սրբուհի Ժ.-ն ասաց, որ իրենք նյութական միջոցներ չունեն ու պնդում են, որ իրենց շահերը պաշտպանի հանրային պաշտպանը:

Նման պայմաններում հաջորդ դատական նիստին դարձյալ կակնկալվի հանրային պաշտպան Վ. Մակյանի ներկայությունը դատարանում:

Դատական նիստը հետաձգվեց անորոշ ժամանակով, մինչև պաշտպանի մասնակցության հարցը դատարանը ճշգրտի հանրային պաշտպանի գրասենյակի հետ:
