ՀՀ քրեական նոր օրենսգիրքը փոփոխություններ է նախատեսում անչափահասների քրեական պատասխանատվության հարցերով

ՀՀ քրեական նոր օրենսգրքի նախագիծը գործող օրենսգրքի մի շարք հիմնարար դրույթներում փոփոխություններ կատարելու հետ մեկտեղ ուղղված կլինի նաև պատժի համակարգի կատարելագործմանը` հատկապես անչափահասների քրեական պատասխանատվության ենթարկելու դեպքում:
Ներկա պահին ամբողջ աշխարհում նկատվող միտումներից մեկն է ազատազրկմանն ու քրեական պատժին այլընտրանք հանդիսացող միջոցների ներդրումն ու կիրառումը: Հայտնի փաստ է, որ ոչ միշտ է ազատազրկումը նպաստում հանցանք կատարած անձի ուղղմանը և նրա վերասոցիալականացմանը: Այլընտրանքային միջոցների կիրառումը` տնային կալանք, ազատության սահմանափակում, հանրային իրավունքներից զրկում, ծնողական իրավունքներից զրկում, օտարերկրյա քաղաքացուն ՀՀ տարածքից վտարում (ՀՀ-ում արդեն ընթացքի մեջ է պրոբացիոն ծառայության պիլոտային ծրագիրը), թույլ են տալիս ապահովելու վերը նշված նպատակները` հասարակական հարաբերությունները զերծ պահելով ավելորդ քրեականացումից:
Անչափահասների քրեական պատասխանատվության և պատժի հարցերին անհրաժեշտ է առանձնահատուկ ուշադրություն դարձնել: Ըստ առաջնահերթության` այս կատեգորիայի անձանց նկատմամբ քրեաիրավական ներգործության հիմնական տեսակները պետք է համարել դաստիրակչական բնույթի հարկադրանքի միջոցները, պայմանական դատապարտումը և պատիժը: Պատժի միջոցի ընտրության հիմքում նախևառաջ պետք է դրվեն անչափահաս հանցագործի անձը բնութագրող բարոյահոգեբանական, ֆիզիոլոգիական, սոցիալ-դերային առանձնահատկությունները, այլ ոչ թե օբյեկտիվ հանգամանքները, այդ է` հանցագործության տեսակը, պատճառված վնասի չափը և այլն:
ՀՀ քրեական նոր օրենսգրքի հայեցակարգով առաջարկվում է վերանայել անչափահասների նկատմամբ կիրառվող դաստիարակչական բնույթի հարկադրանքի միջոցների քրեական գործող օրենսգրքով նախատեսված ցանկը` այն ընդլայնելու և ավելի հստակեցնելու համար:
«ՀՀ քրեական նոր օրենսգրքի նախագծով նախատեսվում է սահմանափակել հանցանք կատարած անչափահասների նկատմամբ ազատազրկման ձևով պատիժ նշանակելու հնարավորությունները. Հայեցակարգով առաջարկվում է առաջին անգամ ոչ մեծ կամ միջին ծանրության հանցանք կատարած անչափահասի նկատմամբ, անկախ տարիքից, որոշակի ժամկետով ազատազրկում չնշանակել: Անչափահասի ազատազրկումը պետք է դիտարկվի որպես պատժի ծայրահեղ միջոց, երբ ակնհայտ է, որ ոչ մի այլ պատժի միջոց չի կարող դրական արդյունք տալ»,- նշված է ՀՀ քրեական նոր օրենսգրքի հայեցակարգում:
